These Terms of Service ("Terms") govern your use of the AgriFarm website and the FarmXO farm management workspace (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a farm or business, you confirm that you are authorised to accept these Terms for it.

1. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract.
• You must give accurate registration details and keep them up to date.
• You are responsible for keeping your password secure and for all activity under your account, including activity by team members you invite. Tell us right away at hello@agrifarm.example if you suspect unauthorised use.

2. Plans and payments

• Starter is free and has no time limit. Professional and Enterprise are paid plans with the features listed on our pricing page.
• Paid plans are prepaid for one billing period at a time (for example a month or a year, as shown for each plan on the pricing page), in USD, through PayPal. Prices are shown before you pay.
• No automatic renewal. We never charge you automatically. To keep a paid plan, renew it before it ends. If you don't, your account moves back to Starter when the period ends. Your data is kept, but features outside Starter become unavailable until you upgrade again.
• Upgrades take effect right away, and you get credit for the unused part of your current period. Downgrades to a lower paid plan are available once your current period ends.
• Refunds: because plans are prepaid and do not renew automatically, payments are generally non-refundable, except where the law requires a refund or where we agree to one, for example after a billing error. Contact hello@agrifarm.example with your invoice number within 14 days of payment if you think a charge is wrong.
• You are responsible for any taxes that apply to your purchase, unless we collect them on the invoice.
• We may change plan prices or features. Price changes apply only to periods you buy after the change and never to a period you have already paid for.

3. Your data

You keep all rights to the farm data and content you put into the Service ("Your Data"). You give us permission to host, store, back up, process and display Your Data only as needed to provide and support the Service. Our Privacy Policy explains how we handle personal information. You are responsible for the accuracy of Your Data and for having the right to enter it, including information about your employees and other people.

4. Acceptable use

You agree not to:

• use the Service for anything unlawful, fraudulent or harmful;
• upload malware, or content that infringes the rights of others;
• try to gain unauthorised access to the Service, other accounts or our systems, or get around plan limits or security measures;
• overload, disrupt, scrape or reverse engineer the Service, except where the law allows it;
• resell or sublicense the Service without our written permission.

5. Farm information is not professional advice

Weather data, reports, calendars, reminders and other information in the Service are tools to help you manage your farm. They may be incomplete, delayed or inaccurate, and they are not agronomic, financial, legal or safety advice. You are responsible for your own farming, financial and business decisions and for following the laws that apply to your operation, including rules on chemical use and labour.

6. Third-party services

The Service relies on third parties such as PayPal, weather data providers and map providers. Your use of their services may be covered by their own terms. We are not responsible for third-party services and cannot guarantee they will be available.

7. Our intellectual property

The Service, including its software, design, text, logos and the AgriFarm and FarmXO names, belongs to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. They do not give you any other rights. If you send us feedback or suggestions, we may use them freely.

8. Availability and changes

We work to keep the Service available and secure, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and we may add, change or remove features. If we remove a major feature of a paid plan during a period you have paid for, we will offer you a fair remedy, such as a pro-rated credit or refund.

9. Suspension and termination

You can stop using the Service at any time and ask us to delete your account by emailing hello@agrifarm.example. We may suspend or close your account if you seriously or repeatedly break these Terms, fail to pay, or put the Service or other users at risk. Where reasonable, we will warn you first. When an account is closed, please export any data you need beforehand. We may delete Your Data after closure as described in our Privacy Policy.

10. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent the law allows, AgriFarm will not be liable for any indirect, incidental, special or consequential losses, or for lost profits, crop losses, lost revenue or lost data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to compensate us for claims, losses and costs (including reasonable legal fees) that arise from Your Data, your misuse of the Service or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of India. Any disputes will be handled by the courts of India, unless the consumer laws of your country give you the right to bring a claim where you live.

14. Changes to these Terms

We may update these Terms. We will change the "Last updated" date above and, for significant changes, tell account holders by email or in the Service before the changes take effect. If you keep using the Service after changes take effect, you accept the updated Terms.
